Terms of Use

The following Terms of Use (these “Terms”) outline the obligations that Think Inside the Box (“our”, “us”, or “we”) owes to you, and the obligations that you owe to us while renting a portable escape room box from Think Inside the Box (the “Box”). Please read these Terms carefully. If you do not agree with these Terms, please do not make a rental-purchase with us. In addition to these Terms, each Box will contain and/or display important safety reminders that you should pay close attention to.  

 

Please note that the Box contains small parts that may be dangerous to children. Children should not be left unattended with the Box. The Box is not intended for persons under the age of 18.

 

  1. Your Reservation.

  1. 1. Making a Reservation. To rent a Box, you must make a Reservation on our Website at www.thinkinsidethebox.net (the “Reservation”). Please ensure that the information provided in your Reservation about yourself is correct. Upon completing your Reservation, you will receive a confirmation email from us that contains further information about delivery or pick-up instructions.

  1. 2. Dates and Duration. Your Reservation grants you the right to use the Box for the specified “Reservation Date(s)”. If you need to cancel or change your Reservation Date(s), please contact us as soon as possible. Cancellation and rescheduling information can be found in sections 3.1 and 3.2 of these Terms.

The Box must be returned before the times discussed in Section 1.4 of these Terms on the final Day of your Reservation Date(s)(the “End Date”). Your End Date is the same as your Reservation Date for single-day rentals, and the following day from your Reservation Date for overnight rentals. Reservation Date(s) are subject to availability, and we hold the right to restrict certain dates from being available.

  1. 3. Delivery. We are pleased to offer free delivery in the Halifax Peninsula as defined by the Halifax Regional Municipality. If you live outside the Halifax Peninsula, delivery is available at an additional fee determined by us. We will ensure that the additional fee is reasonable. If you would like the box delivered to you, we will do so by an agreed-upon time on the day of your reservation. 

 

Alternatively, you may pick up the box from us at no charge. The Box is available for pick up at 5544 Livingstone Pl, Halifax, Nova Scotia, B3K 2B9 on your Reservation Date after 9:00 AM AT. While we will make every effort to deliver or make the Box available within the specified timeframe, we are not liable or responsible for any delays in delivering or providing the Box.

 

  1. 4. Returning the Box. You are responsible for returning the Box to us on your End Date. If your Reservation is for a single day, the Box must be returned by 10:00 pm. If your Reservation is an overnight reservation, the Box must be returned by 12:00 pm on your End Date. If you are unable to personally return the Box, you may arrange a taxi, at your expense, to return the Box for you. 

 

  1. 5. Use of the Box. You are solely responsible for the Box, including all its components, while it is in your possession. The Box should only be used in the manner specified in its instructions.  It is strictly forbidden to modify the Box and its components in any way. We will inspect the Box upon return to ensure all components are complete and undamaged, and that the Box is returned in the same condition that it was delivered to you. 

 

  1. 6. Damage. You will be held responsible for any and all damage to the Box while it is in your possession beyond ordinary wear and tear. “Ordinary wear and tear” means only the normal deterioration of the rental equipment caused by ordinary, reasonable, and proper use. If we determine that the Box is damaged beyond ordinary wear and tear, you will be charged a fee of $100. Such a determination is solely at our discretion. 

 

  1. 7. Eligibility. You must be at least 18 years old to make a Reservation with us.

  1. 8. Organization Accounts. If you make a Reservation on behalf of any organization, entity, or third party, you hereby represent and warrant that you have the authority to bind such entity and agree to these Terms on behalf of such entity. 

 

2. Personal Information. 

 

When reserving a Box with us, you may be asked to provide certain personal information. Only Think Inside the Box personnel, including staff, delivery service personnel, and other individuals directly employed or contracted by us will have access to your personal information for the purposes of fulfilling Reservations. All personal information that will be collected, used, and disclosed is in accordance with our Privacy Policy

 

3. Rescheduling and Cancellation. Policy. 

 

3.1. Rescheduling. We understand that there may be unforeseen changes in circumstances, and we will try our best to accommodate these changes. We ask that you please notify us by email as soon as possible in the event that you need to cancel or reschedule your order. If you wish to change the date of your booking, you can do so at any time, free of charge. Please note that rescheduled  Reservations are subject to availability. 

 

3.2. Cancellation. If you wish to cancel your order, you have 48 hours from the time of your booking to do so to receive a full refund. There will be no refunds for cancellations made less than 48 hours from the start time of your Reservation Date. 

 

4. Fees and Payments. 

 

You are responsible for paying the Reservation fee, including any delivery fees. Your payment will be collected in full when your Reservation is made. Payments must be made via e-transfer or with cash at the time of Reservation. 

 

5. License.

 

Subject to your compliance with these Terms and your payment of any fees owed, Think Inside the Box grants you a non-transferable, non-exclusive license to use of the Box for the specified Reservation Date(s). Nothing in the Terms gives you a right to use the Think Inside the Box names, trademarks, logos or other distinctive brand features without our prior written consent.  

 

You are not permitted to take detailed photos and videos of the Box or how it operates to share online or with others. Please do not spoil the fun of the Box for others by sharing too much information about it. We reserve the right to ask you to remove photos and/or videos of the Box online if We feel it shares too much information as to how the Box operates.

 

6. User Conduct.

 

6.1. Your Obligations. While using the Box, you agree to comply with all Reservation procedures and use your best efforts to return the Box in the same manner as it was provided. You also agree that you will not:

 

a) Intentionally or unintentionally cause harm to, lose or damage the rented Box or any of its contents, steal the Box or its contents, or use the Box in a purpose that is not the Box’s primary purpose;

b) Sub-lease or otherwise rent out or sell the Box;

c) Take detailed photos and/or videos of the Box that spoil its workings to share online and/or with others;

d) Replace, exchange, or modify any of the Box’s contents; or

e) Use the Box for any illegal purposes. 

 

6.2. Indemnity. You agree to defend, indemnify, and hold Think Inside the Box, its affiliates, subsidiaries, directors, officers, employees, agents, partners and licensors harmless from a) any claim or demand, including reasonable legal fees, made by a third party, relating to or arising from the rental of the Box, b) your use of our Website, or c) any violation by you of these Terms.

 

6.3. Links. The Website may contain links to other websites that are not owned or controlled by us. In no event shall any reference to a third party, advertisement, third party product or service be construed as an approval or endorsement by us of that third-party, third-party product, or service. We are not responsible for the content of any linked websites. Any third-party websites or services accessed from the Website are subject to the terms and conditions of those websites. You hereby release us from all liability and damages that may arise from your use of such websites. 

 

6.4. Service Providers. We use third-party integrations to make our Website available. We cannot control how third parties conduct their business or what happens to their business or network. We cannot and will not be responsible or liable for outages to their network, software, or any technology they use in connection with us. 

 

7. Disclaimer of Warranties and Conditions.

 

The Box is provided ‘as is’ and on an ‘as available’ basis. We specifically disclaim all representations, warranties and conditions of any kind relating to the Box, including but not limited to any implied warranties or conditions of merchantability or merchantable quality, satisfactory quality or fitness for a particular purpose. 

 

8. Limitation of Liability.

 

Under no circumstances shall Think Inside the Box be liable for any special, incidental, indirect, or consequential damages whatsoever, including without limitation any damage resulting from a) your use of or your inability to use the Box, b) the cost of procurement of substitute goods, data, information or services, c) errors, mistakes, or inaccuracies in any information available on our Website, or d) personal injury or property damage of any kind whatsoever arising from or relating to your use of our Website or Box, including any bugs, viruses, or other files or data that may be harmful to computer or communication equipment or data that may have been transmitted through or website. 

 

9. Miscellaneous.

 

9.1. Assignment. Customer may not assign these Terms without our advance written consent. 

 

9.2. Applicable Law. These Terms are governed by the laws of the Province of Nova Scotia and the laws of Canada applicable therein and must be interpreted in accordance with them, without reference to any conflicts of law principle that would apply the substantive laws of another jurisdiction and without reference to the UN Convention on Contracts for the International Sale of Goods. Any dispute relating to these Terms or your Reservation must be submitted to a court of competent jurisdiction in the Province of Nova Scotia, to the exclusion of any other court or jurisdiction.

 

9.3. Notices. Any notice or communication under these Terms must be in writing. You must send any notices under this Agreement to Think Inside the Box via mail to its registered office, as well an email copy to od.thinkinsidethebox@gmail.com, and include “[LEGAL NOTICE]” in the subject line.  We may send notices pursuant to these Terms to your email contact points, and such notice will be deemed received 24 hours after they are sent.  We may also provide operational notices regarding the Box via Your email address. Each party consents to receiving electronic notices. 

 

9.4. Amendment to this Agreement. We may change the terms of these Terms at any time, and it is Your responsibility to check the version numbers on these Terms from time to time as any non-material changes will apply to You and you hereby agree to be bound by same.  You will receive notice of any substantial modification of the terms of these Terms by email before the entry into force of the amended Terms. 

 

9.5. Entire Agreement. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.  If any provision of these Terms is held to be invalid or unenforceable, the other provisions of these Terms will be unimpaired, and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

 

9.6. Force Majeure.  No delay, failure, or default, other than a failure to pay fees when due, will constitute a breach of these Terms to the extent caused by acts of war, terrorism, hurricanes, earthquakes, pandemics, other acts of God or of nature, strikes or other labor disputes, riots or other acts of civil disorder, embargoes, or other causes beyond the performing party’s reasonable control.
